Innocalls is one of the services of Mojet Al Wasait Information Technology Company — a Saudi company registered with the Saudi Ministry of Commerce, commercial registration number 1010209660. Below are the company’s obligations toward its users and those dealing with it in every respect, as well as the terms of use and user rights. Accordingly, any use of Innocalls’ services by any person, whether a legal entity or an individual, constitutes acceptance of their legal capacity to be bound by all the terms and conditions mentioned. This agreement takes effect as soon as the user declares their consent by registering on the website or using our services.

Terms of use

Subscribing to Innocalls’ services, whether through the website or any other means, requires agreement to the following terms of use:

  • The service provided by Innocalls under these terms of use includes numerous products and services that help you manage your business’s communications.
  • Any new features or tools added to the current service are also subject to the same terms.
  • Innocalls has the right to update and change the terms of use by posting updates and changes on our website. You are advised to visit the website periodically to review any update that may affect you.
  • You must read all the provisions in the terms of use and privacy policy and agree to them before becoming an official user of Innocalls’ services.

1- Requirements for obtaining Innocalls’ communications management system

  • You must register with Innocalls to benefit from the service by providing your full name as it appears on official documents, your current address, mobile number, a valid email address, and the required official documents (a copy of the establishment’s commercial registration, a copy of the national ID of the establishment’s owner and the authorized person, and the company’s articles of incorporation). Innocalls also has the right to reject an account creation request or cancel an account for any reason under its granted authority.
  • Innocalls has the right to use the email address and mobile number as the primary means of communication.
  • The customer benefiting from the service is responsible for safeguarding the password to their communications system. Innocalls is not responsible for any loss or damage resulting from forgetting or failing to keep the password secure.
  • The customer benefiting from the service is responsible for all communications and activities related to the content of incoming and outgoing calls to their number before the competent authorities, and undertakes not to misuse the communications in violation of the regulations and laws in the Kingdom of Saudi Arabia.
  • Any breach or violation of any term of the terms of use, as outlined under the authority granted to Innocalls, will result in the immediate termination of the user’s services.
  • The customer acknowledges, with full knowledge, that Innocalls’ liability is limited to providing a communications system that enables them to manage their communications and to providing the necessary technical support during the subscription period.
  • The customer benefiting from the service acknowledges, with full knowledge, that Innocalls is not responsible for any service malfunction caused by the telecom service provider (whether STC, GO, or Zain).

2- General provisions

  • You must read all the terms and conditions contained in these terms of use and privacy policy, agree to them, and accept them before becoming an Innocalls customer.
  • Technical support is provided to all Innocalls customers and is only available through the support ticket system and email.
  • The terms of use are governed by and applied in accordance with the applicable laws of the Kingdom of Saudi Arabia, regardless of conflict-of-law principles.
  • Both parties must grant exclusive jurisdiction to the courts of the Kingdom of Saudi Arabia, finally and unconditionally, for any dispute or claim arising from these terms of use.
  • The customer benefiting from the service acknowledges their agreement that Innocalls may amend these terms of use at any time by publishing the amended terms on the Innocalls website, available in the privacy policy, and the amendments to the terms of service apply as of the date of publication. The customer’s continued use of the services after such amendments, once published on the Innocalls website, constitutes acceptance of the amended terms of use.
  • The customer benefiting from the service may not use Innocalls’ service for any unlawful or unauthorized purpose, and may not use the service in a way that violates any laws in force in the Kingdom of Saudi Arabia (including copyright laws) or any other laws applicable to the user, the customer, or announced by the competent authorities in the Kingdom of Saudi Arabia. You will comply with all applicable laws, rules, and regulations in your use of the service.
  • The customer benefiting from the service acknowledges that they may not reproduce, duplicate, copy, sell, resell, or exploit any part of the service, or use or access it, without obtaining Innocalls’ express written permission.
  • The customer benefiting from the service acknowledges their awareness that all calls made through the communications system are recorded on internet servers, and agrees that Innocalls may record these calls, and understands that they can access them through their own communications system as part of the service provided to them.

3- Limitation of liability

  • The customer benefiting from the service agrees and acknowledges that Innocalls will not be liable for any direct, indirect, incidental, special, consequential, or severe damages, including without limitation damages resulting from loss of profit, reputation, use, data, or other intangible losses arising from the use of the service or the inability to use it.
  • In all cases, Innocalls and its distributors are not liable for loss of profits or any special, incidental, or consequential damages arising from its services or these terms of use (including those arising from negligence).
  • The customer benefiting from the service agrees to indemnify and hold harmless Innocalls — as applicable, Innocalls, its parent company, affiliated or related companies, Innocalls’ partners, officers, directors, agents, employees, or suppliers — from any claim or demand, including attorneys’ fees, made by any third party arising from or related to the user’s breach of these terms of use or any referenced documents, or the user’s violation of any law or public rights.
  • Innocalls does not guarantee that the service it provides will be uninterrupted, secure, or error-free.
  • Innocalls does not guarantee that the results of using the service will be accurate or consistent.
  • Innocalls does not guarantee that the quality of any products, services, information, or other materials purchased or obtained by the customer benefiting from the service will meet your expectations, or that any errors in the service will be corrected.

4- Waiver and entire agreement

Innocalls’ failure to exercise or enforce any right or provision of these terms of use shall not constitute a waiver of that right or provision in any way. Your use of the service is governed by these terms of use (the entire agreement between Innocalls and the customer benefiting from the service) and supersedes any prior agreements between you and Innocalls, including without limitation previous versions of the terms of use.

5- Payment of fees and subscriptions

The customer benefiting from the service undertakes to pay the agreed fees in accordance with the final agreement stated in the contract. The payment method shall follow the mechanism agreed upon in the contract, whether it is a subscription, a one-time fee, or a renewal fee, to be paid through any of the payment channels available to us in the accounts provided to the user.

6- Delivery and execution

  • Service execution and system delivery require 5 business days; the customer will therefore receive their service within 5 business days from the date the required subscription payment is made to Innocalls.
  • The required delivery period may change depending on the nature of the customer’s specific requests.
  • Delivery within the specified period depends on the customer’s readiness; accordingly, any delay on the customer’s part that results in a delay in delivering the service within the announced period is the customer’s responsibility.

7- Changes to the service and pricing

  • Service prices are not fixed and are subject to change, with the user to be notified 30 days in advance.
  • This notice may be given at any time by posting the changes on the Innocalls website.
  • Innocalls reserves the right to modify, at any time and from time to time, or discontinue the service (or any part of it), with or without notice.
  • Innocalls is not liable to the customer benefiting from the service or to any third party for any modification or change in pricing, or for the suspension or discontinuation of the service.

8- Third-party services

  • In addition to these terms, the customer benefiting from the service agrees to comply with the additional terms of use that apply to services purchased, or to services provided by Innocalls’ partners or other third parties.
  • Innocalls may, from time to time, offer or grant the customer benefiting from the service third-party programs, products, or services. These third-party services are provided solely for the customer’s convenience, and any purchase, access, or use of any third-party service is solely between the customer and the official third-party service provider (“Third-Party Provider”). Any use of the third-party services provided is the sole responsibility of the customer benefiting from the service, who is also responsible for reading the terms, conditions, and privacy policies applicable to the third-party services before using them.
  • Innocalls provides no warranties with respect to third-party services. The customer benefiting from the service acknowledges that Innocalls has no authority over third-party services and is not responsible for any party related to these third-party services. The provision of third-party services, and the activation of and integration with third-party services, does not constitute or imply any endorsement, licensing, sponsorship, or affiliation by Innocalls with the third-party service provider.
  • If the customer benefiting from the service installs or enables a third-party service for use with the services, they grant Innocalls permission to allow the applicable third party to access their data and take any other actions required to activate the third-party service with the services, and any data exchange or other interaction between the customer benefiting from the service and the third party remains between them. Innocalls bears no responsibility for the disclosure, modification, or deletion of the customer’s data or store content, nor for any resulting losses or damages arising from access by a third party or a third-party service provider to your data or store content.
  • Under no circumstances shall Innocalls be liable for any direct, indirect, incidental, special, consequential, punitive, exceptional, or other damages of any kind arising from any third-party service or your contractual relationship with any third-party provider. These limitations apply even if Innocalls has been notified of the possibility of such damages. The foregoing limitations apply to the fullest extent permitted by applicable law.
  • The customer benefiting from the service acknowledges that they agree to indemnify and hold harmless Innocalls, its parent company (as applicable, subject to judicial process), affiliated and related companies, Innocalls’ partners, officers, directors, agents, employees, and suppliers, from any damage arising from any claim, including attorneys’ fees, arising from your use of a third-party service or the user’s relationship with a third-party provider.

9- Fees and billing terms

Innocalls offers 3 packages at different prices:

The first is the Starter package, priced at SAR 99 per month

The second is the Startups package, priced at SAR 249 per month

The third is the Business package, priced at SAR 449 per month

You can subscribe to any of the packages on a monthly, annual, quarterly, or semi-annual payment basis

Fees

Innocalls’ fees are due and payable in the required amount on the specified invoice date. Fees are to be paid in Saudi Riyals unless otherwise agreed. If you pay by credit card, Innocalls will automatically renew the subscription on your specified invoice date.

Refund policy

Innocalls’ fees are based on the service purchased, regardless of the service’s actual usage, and are non-refundable. All Innocalls subscriptions, whether monthly or annual and regardless of package type, are non-refundable; however, the customer may cancel their subscription at any time and stop using Innocalls’ services whenever they wish. The subscription renews automatically on your specified invoice date. Innocalls sends you a message a number of days before the renewal date to inform you that payment is due before the end of the renewal period, and if you wish to cancel your subscription, you may contact Innocalls directly.

Taxes

Our package prices do not include Value Added Tax (15%), which is added to all Innocalls services and is registered under tax registration number: 302003414500003. Taxes are subject to review and adjustment in accordance with the regulations of the Zakat, Tax and Customs Authority in the Kingdom of Saudi Arabia.

Subscription cancellation

Billing inquiries

You are responsible for reviewing your invoice and have a period of 3 days from the invoice date to notify us of any dispute or objection. Failure to do so within the specified period constitutes your agreement to all charges on the invoice and a waiver of any claims you may have regarding the fees and the invoice as a whole.
